Warranty and Other Disclaimers

MBD Alchemie Pvt. Ltd. (the owners of www.mbdalchemie.com), henceforth "MBD Alchemie", offers no guarantees of student performance in tests and cannot be held liable for any damages due to poor student performance.

The materials and information on the MBD Alchemie™ website are provided "as is," without warranty of any kind, either expressed or implied, including without limitation any warranty for information, services, or products provided through or in connection with the MBD Alchemie™ web site and any implied warranties of merchantability, fitness for a particular purpose, expectation of privacy or non-infringement.

Some jurisdictions do not allow exclusion of implied warranties, so the above exclusion may not apply in such cases. MBD Alchemie and its affiliates do not warrant that the services provided by MBD Alchemie™ or the site will be free from bugs, defects or errors, or accessible without interruption.

Scratch card: Terms & Conditions

1.    Company shall mean “MBD Alchemie Pvt. Ltd.”

2.    Subscriber shall mean the purchaser of the cash card.

3.    Card shall mean the cash card.

4.    The company reserves the right to change the validity period at any time, at its sole discretion and without any notice, whatsoever.

5.    The details of the usage of the card shall not be made available to the subscriber. The subscriber agrees that the Company need not entertain any correspondence/calls in this regard.

6.    Not all Services available to the Company shall be made available to the subscriber on this subscription. The company is entitled to charge, vary, add, and withdraw any services and / or vary the charges/prices on these services at its sole discretion.

7.    Any service which is not initially or at any stage charged by the company may, at the sole discretion of the Company, be charged at any time subsequently and at the same time shall be adjusted in the calling value automatically.

8.    Any increase /addition/introduction in taxes and /or levy of any taxes, levies, duties or any other statutory charges etc. (present/future) shall be applicable to the subscriber’s account without any notice to him.

9.    The company may, at any time, suspend the services, wholly or partially, and/or disconnect any subscriber’s equipment from the network for any reason which is found to be reasonable by the Company.

10.  If the subscriber’s card is lost or stolen, the Company will not be in a position to take any action, or to be held liable for any good and the entire liability shall be borne by the subscriber. No credit shall be given on the available balance of such card.

11.  The company makes no express or implied warranties, whatsoever, regarding the service etc. and shall not be liable to the subscriber or any other persons (legal/natural) on Subscriber’s behalf.

12.  The subscriber agrees to waive and continue waiving any/all claims for any loss, delays, costs, expenses, fees, judgments, damages- direct, incidental or consequential arising out of any mistakes, omissions, interruptions, delays, errors, defects or any other failures with respect to the Company.

13.  The company shall not be responsible for any civil or criminal liability (i.e. for any acts of commission or omission) incurred by the Subscriber due to any misuse of the services provided by the company.

14.  The company shall not be liable for any act of commission or omission of any dealer/retailer/third party offering any privilege or benefits to subscriber without specific permission or authority of the company.

15.  Service quality, functionality, availability and/or reliability may be affected, and the company is entitled, without any liability, whatsoever, to refuse, limit, suspend, vary or disconnect the service, in whole or in part at any time, at its sole discretion, without any notice, for any reason which is found reasonable by the Company.

16.  The company may, at its sole discretion, vary, alter or amend any terms and conditions due to regulatory, administrative and/or commercial compulsions or for any other reason considered necessary in the interest of the business operations.

17.  All disputes relating to this card shall be to the exclusive jurisdiction of the Courts of New Delhi, and the laws of India shall be the governing laws.
